Terms and Conditions

Pricing

The pricing for your order is determined by the quote provided or the listed price on our website, unless otherwise required to be adjusted as outlined in the terms and conditions here.

Order Cancellation

We prioritize quick processing of all orders, which means once an order is placed, it cannot be canceled.

Product Variations

Each item in our Tiffany Lamps collection is a handcrafted, unique work of art. The natural variations in the materials we use ensure that every product is a one-of-a-kind masterpiece. Please note that the photographs on our website serve as a general representation of the product, and actual colors and designs may vary.

Payment Terms

The terms of payment are specified in your sales document. All in-stock items require full payment before shipping. For custom projects, a 50% non-refundable deposit is required before production begins, with the balance, including freight and other charges, due before shipping. If, at any point, the seller deems the buyer’s financial condition inadequate to continue production or shipment under the agreed terms, the seller may require full payment in advance.

Acceptance of Custom Order Quotations

Custom order quotations are valid for 30 days from issuance. Acceptance must be provided in writing and is subject to the terms and conditions outlined in the quotation. Any terms in the buyer’s order form that contradict the terms of this quotation will be superseded by the terms stated herein.

Custom Project Initiation

A custom project will commence only after the following conditions are met:

  1. Receipt of a 50% non-refundable deposit.
  2. Approval from the buyer on completed drawings, including all relevant details such as style, function, measurements, colors, and finishes. The signed approval is the buyer’s directive to the seller in full.

The buyer is responsible for ensuring that all instructions and specifications on the approval sheet are accurate and complete. Any subsequent changes to the project by the buyer may incur additional charges. The seller reserves the right to adjust the quoted pricing after receiving the signed approval sheet if necessary.

Lead Times

Lead times provided are approximate and may change. The seller is not liable for delays in production or delivery caused by factors beyond their control, including but not limited to acts of God, government actions, labor strikes, or transportation issues. Merchandise will ship once it is ready, payment has been received, and transportation is available. Any delay in shipment requested by the buyer must be agreed upon by the seller, who may charge additional storage fees for delays exceeding 28 days.

Production Changes

During production, it may be necessary to make design changes for engineering or mechanical reasons to ensure the product’s safe operation and longevity. The seller will not be penalized for such changes.

Price Escalation

If the cost of raw materials increases after the buyer’s order is accepted, the prices quoted will be subject to revision at the time of shipment.

Shipping

Unless otherwise stated, all merchandise ships F.O.B. Origin, Freight Prepaid, and Add. The seller will select the safest and most cost-effective shipping method and is not liable for delays or excessive transportation charges. In some cases, additional shipping charges may be requested if the cost exceeds the amount paid by the buyer. The buyer may choose to cover the additional cost or receive a full refund.

Miscellaneous

Light bulbs are not included with your shipment. If required, the buyer must notify the seller in writing, and this must be noted on the approval sheet. Additional charges will apply.

Promotion

The seller reserves the right to photograph all merchandise for advertising and promotional purposes, crediting designers where appropriate.

Receipt of Goods via Common Carrier

The buyer must thoroughly inspect all packages and merchandise in front of the delivery driver before signing the Delivery Receipt (DR). By signing, the buyer confirms the merchandise was received in good condition. Any visible damage or issues must be noted on the DR before signing to ensure the validity of any damage claims.

Warranty

Products are warranted to be free from defects in material and workmanship for one year. The warranty covers defects in manufacturing only and does not cover damage from misuse, unauthorized modification, or normal wear and tear. There are no warranties beyond those expressly stated in this agreement.

Color Variation

While we strive to match the buyer’s desired colorations, variations in finishes, paints, dyes, glass, and materials are to be expected and do not constitute grounds for cancellation or price adjustment.

Patent Infringement

The buyer agrees to indemnify and hold the seller harmless from any liability, including attorney’s fees, arising from the manufacture or use of any patented device or part not owned or controlled by the seller.

Returns

Custom-made items cannot be returned. Unauthorized returns will not be accepted. If an item needs to be returned for repair due to buyer error, the buyer will be responsible for all associated costs.

Correction of Errors

The seller reserves the right to correct any typographical or clerical errors in prices or specifications.

Tools, Molds, and Scrap

All tools, molds, and scrap materials used in the production process remain the property of the seller.

Customer’s Material

Materials provided by the buyer must be shipped freight prepaid, and the buyer assumes all risk of loss or damage. The buyer indemnifies the seller against any claims arising from the use of these materials.

Limitation on Waiver of Breach

Any waiver by the seller of a breach of this contract is limited to that instance and does not constitute a waiver of future breaches or invalidate the seller’s rights.

Seller’s Remedies

The seller’s rights and remedies under this contract are cumulative, and the exercise of one does not preclude the exercise of others.

Entire Agreement

This contract constitutes the entire agreement between the parties and can only be modified by a written agreement signed by both parties.

Governing Law

This contract is governed by the Uniform Commercial Code of the state chosen by the seller. In case of breach by the seller, the buyer is not entitled to consequential damages.
